These terms govern your use of Doak. Please read them carefully — by using the Service, you agree to them.

1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and Doak ("Doak", "we", "us"). By creating an account or using our website builder and business management portal (the "Service"), you agree to these Terms and to our Privacy Policy.

If you are using the Service on behalf of a business, you confirm you are authorized to accept these Terms for that business.

2. The Service

Doak provides a no-code platform to build and host a business website and to run a management portal tailored to your industry — including features such as bookings, orders, listings, enquiries, content, and analytics, depending on your business type.

We may add, change, or discontinue features from time to time to improve the Service.

3. Your account

  • You must provide accurate information and keep it up to date.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must be of legal age and have the capacity to enter into a binding agreement.
  • Notify us promptly of any unauthorized use of your account.

4. Fees and billing

  • The Service is provided at the pricing agreed between you and Doak for your business. We will confirm your pricing and billing period before any charge.
  • You can cancel at any time by contacting us or from your account where available; cancellation takes effect at the end of the current billing period unless we agree otherwise.
  • Fees are exclusive of taxes unless stated otherwise; you are responsible for any applicable taxes.
  • Domain registration and renewal fees are separate and may be non-refundable once purchased.
  • Except where required by law or agreed in writing, fees already paid are non-refundable.

5. Your content and data

You own the content and data you add to the Service, including your website content and the records about your own customers. You grant Doak a limited licence to host, store, process, and display that content solely to operate and provide the Service to you.

You are responsible for your content and for ensuring you have the rights to use it, that it is lawful, and that you handle your visitors’ and customers’ data in compliance with applicable laws.

6. Acceptable use

You agree not to use the Service to:

  • Break the law or infringe the rights of others, including intellectual property and privacy rights.
  • Upload malware, or attempt to disrupt, overload, or gain unauthorized access to the Service.
  • Send spam or unlawful, deceptive, or harmful communications.
  • Sell prohibited, counterfeit, or illegal goods or services.
  • Impersonate others, scrape the Service, or reverse-engineer it except as permitted by law.
  • Resell or provide the Service to third parties except as expressly permitted.

7. Our intellectual property

The Service, including its software, design, templates, and branding, is owned by Doak and its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service while your account is in good standing. These Terms do not transfer any ownership of the Service to you.

8. Third-party services

The Service integrates with third parties such as payment gateways, domain registrars, and other tools. Your use of those services is governed by their own terms, and we are not responsible for third-party services.

9. Payments

Payments are processed by third-party payment providers. By subscribing or purchasing, you authorize the applicable charges. You are responsible for any chargebacks, reversals, or fees arising from your account.

10. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that may cause harm or legal liability. Where reasonable, we will give you an opportunity to export your data before termination.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Limitation of liability

To the maximum extent permitted by law, Doak will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months before the claim.

13. Indemnification

You agree to indemnify and hold Doak harmless from any claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

14. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law principles. The courts located in India will have exclusive jurisdiction over any disputes arising from these Terms or the Service, subject to any mandatory rights you may have under local law.

15. Changes to these terms

We may update these Terms from time to time. We will revise the “Last updated” date above and, for material changes, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
